MetConc LLC: Internal Vocabulary & Definitions
I. Structural & Material Terms
-
Substitution: The act of replacing a specified component, material, or hardware item with an alternative. In our context, unauthorized substitution (e.g., using different bolts or panels) voids the structural integrity and warranty.
-
Modification: Any physical change to the structure’s "As-Built" state, including drilling, cutting, or welding.
-
Addition: The attachment of external or internal elements not included in the original signed design (e.g., adding a lean-to, spray foam, or lofts).
-
Dead Load: The permanent weight of the building materials themselves, plus any permanent attachments (like insulation or HVAC units). Our structures are engineered for specific dead loads; exceeding them is a safety violation.
-
12-Gauge vs. 14-Gauge: * 12-Gauge: Thicker, stronger steel framing that carries our Rust Warranty.
-
14-Gauge: Industry-standard framing; thinner than 12-gauge and excluded from the Rust Warranty.
-
II. Site & Installation Terms
-
Level & Squared: A site that is flat within a 1% grade and has 90-degree corners. A site that "looks" flat but isn't can lead to "As-Is" installation and voided warranties.
-
Clearance (25ft Radius): The unobstructed workspace required for our crews to safely operate machinery, staging, and lifting. This is a "Safety Zone."
-
"As-Is" Installation: An installation performed on a site that does not meet MetConc LLC's preparation requirements (usually unlevel). This is a "final sale" state with no future workmanship or structural recourse.
-
Incidental Damage: Standard, expected wear-and-tear to the ground or surrounding property caused by heavy equipment and steel delivery (e.g., tire ruts or minor scratches to nearby fences).
III. Financial & Legal Terms
-
C.O.D. (Cash on Delivery): Payment is due the moment the crew completes the build. "Delivery" refers to the completed structure, not just the arrival of materials.
-
Material Volatility: The risk of price increases in the global steel market. This clause protects the company if a project is delayed by the buyer while raw material costs rise.
-
Repossession: The legal right of MetConc LLC to dismantle and remove the structure from the Buyer’s property if the balance is not paid.
-
Force Majeure: "Superior Force"—unforeseeable circumstances (like a Texas hurricane or a global pandemic) that prevent us from fulfilling a contract on time without being "at fault."
IV. Warranty & Service Terms
-
Workmanship: Refers specifically to the quality of the assembly (screws tightened, panels aligned, trim attached). It does not refer to the quality of the steel itself.
-
"The Gap" (Pre-Trade Inspection): The critical window after we finish the shell but before the Buyer's plumber or electrician starts work. This is the "Point of Acceptance."
-
Film Integrity: A technical term for the paint's ability to stay attached to the steel without peeling or flaking. It does not cover "crazing" (tiny surface cracks from bending the metal).
